KKL won an important victory in the First Department of the New York Appellate Division in connection with its representation of a branch of the Sol Goldman family in ongoing litigation in the Commercial Division concerning the value and management of the Goldman family’s multi-billion-dollar New York real estate empire.
KKL appealed from a Supreme Court order that granted defendants’ motion to compel the production of its clients’ attorney-client privileged materials. The trial court held that KKL’s clients’ production of non-privileged transcript-style notes of a conference call concerning the appraisal of the Goldman family’s real estate business had effected a broad subject matter waiver over related privileged materials.
On March 19, 2026, the First Department reversed. The appellate court held that the transcript-style notes of the conference call were not privileged material or attorney work product and, as a result, the production of the transcript-style notes in discovery did not effectuate a broad subject matter waiver over related privileged materials.
